Foreclosure Procedure – The Basic Steps

Although every foreclosure is unique and there is never one solution that works for everyone, there are some basic foreclosure steps that happen in every foreclosure procedure.

It all starts with missing that first payment. Your foreclosure procedure has not yet begun at this point but if you miss two or three payments, you will probably be headed into foreclosure. This is the point where you have the best chance of avoiding foreclosure and saving your home. Talk to your mortgage company immediately about why you missed the payment and ask them what they can do to work with your situation.

Typically within 60 to 90 days after you have missed that first payment, your mortgage company will start foreclosure. You still have the opportunity to save your home at this point in the foreclosure procedure but it just got a little harder. Lawyers have now gotten involved and so have the courts.

After this point, the timeline that your state has for the foreclosure procedure becomes a factor. It could move very quickly after this point or it could take quite a while. You need to understand the laws for your state in order to know how quickly it will move at this point.

Understand What Your Foreclosure Rights Are

There is no simple or one-size-fits-all answer for what your foreclosure rights are. Every state has different laws that govern the foreclosure process in that state. You need to find out what the laws are in your state and what your rights are.

This is not always easy to find out but a good place to start is your local county website. I know that in my case, my county’s website had the most detailed information about what my foreclosure rights are and where I was in the foreclosure process.

For me, all of the documents that my mortgage company’s lawyers had to file were all on this website. It was a great way for me to keep myself informed about what was going on in my foreclosure.

Another good thing to do in order to fully understand what your foreclosure rights are is to hire an attorney. They will be fully versed in what the laws are that govern foreclosure in your state and what your options are to stop foreclosure.

Help With Foreclosure

Finding people to help with foreclosure can often feel like an uphill battle. It can also simply be difficult to ask for help. I had to often remind myself of what the costs would be if I didn’t ask for help during my foreclosure. The costs are high. The loss of your home and the loss of the ability to have another home for several years (estimates I’ve seen range from 3 to 7 years). Providing a home for my daughter was a priority for me. Looking in her face reminded me of what I was fighting for.

Okay, so how do you actually go about getting help with foreclosure? Surprising but true, one of my best resources for help was my mortgage company’s foreclosure department. They helped me understand how the foreclosure process worked with my mortgage company and what I needed to do in order to save my home.

The one thing I did not do that I wish I did during my foreclosure was get help with foreclosure from an attorney. I did not fully understand my rights or everything that I was signing. An attorney who understands the rules and who could have explained things to me would have been extremely helpful.

What To Do To Stop Mortgage Foreclosure

You always have options when it comes to being able to stop mortgage foreclosure. The key is finding the right option for you and your situation. There is never a one-size-fits-all proposition when it comes to foreclosure. The solution I came to in order to save my home may not work for you.

The one thing you do need to do right now if you haven’t is talk to your mortgage company. You will never stop mortgage foreclosure if you don’t find a way to work with your mortgage company. The ways that you can do this vary. You can deal with them directly, hire an attorney to help you or find a foreclosure specialist to help you. But one way or another, dealing with your mortgage company is a given.

Chances are good that you will need to come up with at least some money in order to stop mortgage foreclosure on your home. It’s going to be hard to convince the mortgage company that you want to save your home if you can’t find a way to come up with at least some money.

Working With Your Mortgage Company In Your Foreclosure Procedure

Learning how to work with your mortgage company in your foreclosure procedure is vital if you expect to stop mortgage foreclosure on your home. But you have to understand that your mortgage company is your mortgage company. There is nothing you can do to change that at this point. They may be an absolute nightmare to deal with when it comes to your foreclosure procedure. The important thing is to be persistent and not give up.

You are going to have to deal with them in order to save your home. That is simply a fact. Come to terms with that and find a way to work with them. Here are some things that helped me in dealing with my mortgage companies during my foreclosure procedure.

  • Persistence in calling them. I would call and continue to call until I received an answer. Try not to be annoying about it though or they may not call you back.
  • Clarifying everything. If I did not understand something or had a question, I called. If I did not receive documents when I thought I should, I called.
  • Being calm and rational when I called them. Now I admit it, this did not always happen during my foreclosure procedure but I tried. I always received a much better response when I was calm and rational.

Planning To Stop Mortgage Foreclosure

If you expect to stop mortgage foreclosure on your home, it is going to require that you do some planning.

Planning out how you will get the money you need. This one involves figuring out what your mortgage company wants and then coming up with a plan for how you are going to get it. I had to do this in order to stop mortgage foreclosure on my home. It was not detailed, just a list of what the mortgage company wanted and different ways that I could get the money they wanted.

Planning out who you are going to ask for help and what you will need from them. Lets face it, if you are going to stop mortgage foreclosure on your home, you are not going to be able to do it by yourself. You will need help. In my situation, that meant calling on friends and family to help me in many different ways. Was it easy to own up to my friends and family what was happening? No, but it was vital for me to do in order to save my house.

Bottom line, you will need to figure out how much money you need, where it is going to come from, and who you know that will be able to help you stop mortgage foreclosure.

I am in Foreclosure right now. I have heard that there are government assistance programs for those who are in trouble and in Foreclosure. Does anyone know any government programs and how to access those programs?? :-( :-(

What You Can Do To Stop Foreclosure Sale

Finding a way to stop foreclosure sale on your home can feel impossible when you are in the middle of foreclosure and a sale date is looming. I know how scary that can be, I’ve been there. But it is possible to stop it, you just need to figure out how to do it.

Talking to your bank is a good first step. If you work with them, you might be able to ask them to have their lawyers submit a continuance on the foreclosure sale date that will delay the sale. The lawyers for my mortgage company did this automatically as soon as I worked with my bank and signed a legal agreement to make a portion of the payments. Finding some way to work with your bank is critical if you want to stop foreclosure sale.

Getting your own lawyer to help you understand your options is also not a bad idea. They can help you understand the foreclosure process and how to stop foreclosure sale on your home. If you can possibly afford an attorney, it is always a good idea to have your own legal advice to help you during this time.

Using Your Legal Right To Stop House Foreclosure

Every state has laws that govern foreclosure and the foreclosure process. You can stop house foreclosure if you know what those rights are and how to use them to your advantage. In many states, you have a right to cure option that can help you save your home.

This right to cure gives you the option of essentially coming up with the money necessary to reinstate the loan with your mortgage company. Word of warning though: there will be attorney fees, late fees and other “miscellaneous” fees that you will be expected to pay.

You will also need to file the appropriate paperwork in order to make this happen. For my situation, I had to file an intent to cure and had to find my foreclosure number, date that the deed was recorded on my property and the recording number for the deed. All of this information was fairly easy to find on the documents that my mortgage company’s lawyers sent me.

Using the intent to cure is a great way to help you stop house foreclosure but you will need to be prepared to come up with all of the money necessary to reinstate your loan.
