A Starting Place to Understand Your Foreclosure Rights

Saturday, January 31st, 2009

If you want to know what your foreclosure rights are, a good place to start looking is your deed of trust. In some instances, this deed of trust will tell you when your lender has the right to foreclose on your home.

These documents should help you understand when your lender has the right to begin foreclosure on your home, what notices they are required to give you, and what you have to pay them to get your loan current and reinstated.

On my own deed of trust, it spells out very clearly exactly how my foreclosure procedure went and what I had to do to reinstate the loan. It clearly spells out that I have to pay all attorney fees and other fees associated with the foreclosure. It also spells out clearly the notices that they gave me and exactly how they went about filing for foreclosure on my home. It also gives some details about timelines in there of when they can initiate foreclosure.

During my own foreclosure process, I wish I had looked at my deed of trust to understand what my foreclosure rights were. If you want to understand what your foreclosure rights are, I highly suggest you take a look at your deed of trust.

Taking Responsibility in Your Foreclosure Procedure

Monday, January 26th, 2009

Let me start by saying that the foreclosure on your home is not your fault but it is your responsibility. What does that mean? It means that you need to take responsibility for the part that you have played and that you continue to play in your foreclosure procedure. This is not easy and requires a brutal kind of honesty with yourself that many of us would rather not take on.

I know that being honest with myself was something that I did not want to do during my foreclosure procedure. It required me to really look at what I had done and take responsibility for the role I played in it. It is far easier in foreclosure and in life to blame the outside world for what is happening in your life. But I encourage you to really get honest with yourself about the role that you have played in it. Not to beat yourself up for your mistakes, but so that you learn from it and so that you can move forward in a positive direction in your foreclosure procedure.

When I really took responsibility for my actions, that is when I was able to move forward in a positive way in my foreclosure procedure. It was not easy but as soon as I did that, I was able to make things happen and stop foreclosure.

Stop Mortgage Foreclosure with Hard Work

Wednesday, January 21st, 2009

President Obama’s inauguration speech reminded me of what I had to do to stop mortgage foreclosure on my home. Lots of hard work, responsibility and action. You will need these things as well in order to stop mortgage foreclosure on your home. Saving your home from foreclosure is not easy. You will have to work with your mortgage company. You will have to work to come up with the money that you need.

And you will need to take on a new financial responsibility. This means getting honest with yourself about what you spend money on and what are truly necessities in your life as opposed to niceties. You will need to find a way to cut back if you want to stop mortgage foreclosure on your home. You will need to find a way to downsize your lifestyle.

And you will need to act. Do something every day, even if it is a small thing, to stop mortgage foreclosure on your home. Doing something is better than doing nothing. The more you act and continue to act, the closer you will be to saving your home.

President Obama reminded us of what this country was founded on and that the path ahead will not be an easy one. Neither will the path for you if you want to stop mortgage foreclosure. Are you ready for the challenge?

Can You Stop Foreclosure Sale?

Monday, January 19th, 2009

Can you stop foreclosure sale on your home before it is too late? That depends mainly on you. If you do want to stop foreclosure sale, you will need to work quickly and get well educated about foreclosure. The more you know and the more you do with what you know, the greater chance you have of being able to stop foreclosure sale on your home.

You need to work quickly with your mortgage company. You need to do this in part because they will have a tendency to work slowly. Give them all of the paperwork they need as soon as you can. If they leave you a message, return their call as soon as possible. If you want to stop foreclosure sale, you have to provide your mortgage company with exactly what they need when they need it or even before they need it.

Getting well educated about foreclosure means doing some digging and taking the time to truly understand all of the paperwork and legal documentation that the mortgage company sends you. In order to understand your foreclosure, it is good to know what the foreclosure laws are for your state and what your state’s foreclosure timeline is. Whether or not you can stop foreclosure sale depends at least in part on those dates. You have to know when your foreclosure sale date is in order to stop it before it happens.

Top 3 Things I Learned In My Foreclosure Procedure

Tuesday, January 13th, 2009

My foreclosure procedure taught me many things about how foreclosure works and about myself. There is a lot that you can learn from foreclosure if you open yourself to the lessons that you are being taught. Here are the top 3 things that I learned during my own foreclosure.

You can not expect to stop your foreclosure procedure unless you talk to your lender. It is easy to bury your head in the sand and pretend that foreclosure is not happening to you. I did this for more months than I care to remember. Call them. Talk to them. See how they can work with you. You will never know what solutions they can offer you unless you ask.

I also learned that there are a lot of scam artists out there who are ready to take advantage of homeowners. Once your foreclosure procedure becomes public knowledge, the scam artists will start crawling out of the woodwork. They will tell you that they can save your home from foreclosure and they will ask for a lot of money upfront.

You have to believe in yourself and in your ability to stop your foreclosure procedure. If you do not believe that it is possible for you to save your home, you won’t. You cannot create something that you believe it is impossible for you to create. You have to know that you can save your home and be willing to do what you need to do in order to make that happen.

How Did You Stop House Foreclosure?

Monday, January 12th, 2009

If your house is in foreclosure, I hope that this is a question that you will be able to answer someday. I’m glad to say that it is a question that I can answer today. It can feel like it is impossible to stop house foreclosure when you are in the middle of it but I am here to tell you that you can make it out. Let me share with you a little of how I did.

I believe that the biggest thing that helped me stop house foreclosure was working with my mortgage companies to find a solution. Not always easy but necessary in order to save my home from foreclosure. I was doggedly persistent in my calls to them. I sometimes repeatedly provided them with the same information over and over again. I asked them what they needed from me in order to help me save my home.

The other thing I did that I think made a big difference is that I took responsibility for all of my actions. No matter how your house ended up in foreclosure, I challenge you for a moment to ask yourself “How did I create this?” I took a good look at what I did to create this in my life and took responsibility for all of the actions that led to the foreclosure of my home. I do not think that I would have been able to stop house foreclosure unless I had taken full responsibility for everything that led to my foreclosure.

Do You Know How to Protect Your Foreclosure Rights?

Saturday, January 10th, 2009

I hope you do because no one else is going to protect them for you. You cannot count on anyone else to look after your foreclosure rights for you. So how do you protect them?

The best first step is to find out what the foreclosure laws are in your state. A lot of what your rights are and are not are determined by the laws of your state. Do what you need to do to get this information. Not only will it help you protect your foreclosure rights but it will also help you understand what is coming next in your foreclosure.

Another great step is to figure out exactly where you are at in the foreclosure process. The laws for your state will have timelines associated with them that determines how long you really have to save your home. You have to know where you are at in the process in order to understand how you can protect your foreclosure rights at your stage of the game.

Where to Find Help With Foreclosure

Wednesday, January 7th, 2009

Help with foreclosure can come from many places . . . if you know where to look. Finding resources that can help you is one of the best things that you can do for yourself in order to stop mortgage foreclosure on your home. So where are some of the places that you can look for help with foreclosure?

Don’t be too shocked but the foreclosure specialist at your mortgage company can be a good resource and source of information about foreclosure. They can also help with foreclosure by letting you know what documentation you need to provide to the mortgage company. My disclaimer here is that they do work for the mortgage company, not for you, so make sure that you get other advice and information as well.

Another good place to look for help with foreclosure is your state’s website. Given the current foreclosure crisis in the U.S., pretty much every state has resources devoted to helping people save their homes from foreclosure. Many have websites devoted to this problem and others have a phone line you can call to get help.

How It Is Possible to Stop Mortgage Foreclosure

Monday, January 5th, 2009

As we start a new year, it is a good time to reflect on possibilities. I believe in possibility and that no matter where you are in the foreclosure process that it is possible for you to stop mortgage foreclosure and save your home. I saved mine with less than 30 days to go to the sale date so I believe that it is possible for you to save yours. Live in a space of possibility.

There is a lot of information out there about how to save your home from foreclosure but very little, if any, of it has to do with your mental attitude and how you are thinking about your foreclosure. Many people, including myself, choose to live in state of denial about their foreclosure. “This is not happening to me.” Denial will not stop mortgage foreclosure on your home. Thinking in possibility will.

You cannot escape the fact that your house is in foreclosure. You simply can’t. But you can decide how you will think about it. Choose to think of ways to save your home. Choose to educate yourself about how to save your home. Think of at least one thing every day that will help you save your home. Research one way every day to stop mortgage foreclosure on your home.

By doing these things every day, you will be one step closer to saving your home.

Can You Stop Foreclosure Sale?

Sunday, January 4th, 2009

Yes, you absolutely can. But you are going to need to have some tools, plans and processes in place in order to stop foreclosure sale on your home.

Tools
One tool is going to be some money. Chances are that you’re going to need to come up some cash in order to stop foreclosure sale on your home. An attorney to help fight for you and explain your rights to you is another good tool to have on your side.

A Plan
If you fail to plan, you plan to fail. Come up with some sort of plan, any plan to stop foreclosure sale on your home. Even a bad plan is better than no plan at all. Just make sure that it is a plan that you believe is possible for you.

Processes
No matter how small, do something, anything, every day to stop foreclosure sale on your home. Call your mortgage company. Do some research at the library or on the internet. Do something every day. Small steps are better than no steps.
