I JUST RECEIVED A NOTICE OF ENTRY. THE BUILDING IN WHICH I RENT AN APARTMET FROM IS IN FORECLOSURE. WHAT IS THE NEXT STEP? HOW LONG DO I HAVE TO MOVE? I REACHED THE PLAINTIFF’S ATTORNEY AND THE INFORMED ME THAT THE MORTGAGE WAS DEFAULTED SINCE JULY 2009. SHOULD I CONTINUE PAYING RENT? AM I PROTECTED IN ANYWAY? I CANNOT AFFORD TO PAY RENT AND HAVE MOVING EXPENSES. PLEASE LET ME KNOW WHAT IS THE NEXT STEP AND HOW LONG DOES THIS PROCESS TAKE.

You wont have to move, whne a bank forecloses on an apartment they are required to hire a manager and continue to rent to you. it may even be the present manager. You really should not be effected at all. You would only have to leave if you defaulted on rent.

You are looking at least 7 years.

A bankrupsy only gives you a little more time. You can only stop the procedure by bringing your account current.

They are required to send you notification of foreclosure. That being said if they are sending you notices that you are past due that will suffice as warning. I have been in the banking industry for over five years. Lenders do not have to write you a letter telling you they are starting the foreclosure process. You signed a contract that has all this information. How many months are you currently behind? When you say working with Fannie Mae how are you working with them? Did you get a refi or some sort of aid?

Church had to go into forclosure
1 day after the church sold, pastor of church called the sheriffs offfce to see how long they had to get all of their things out, He was told, they had until 8/0108…
Pastor went Monday 7/28 to make arraingement to get the things that was left, before the new owner took possesion of the property.
At that time he found out that the new owner had already gotten into the property and sold ALL! of the churches belongings at a yard sale.
The pastors called the sheriff office, and was told again the sale had not been finalised and the buyer had no legal right to enter the property, nor sell the churches property, until all of the paper work was processed and ownership turned over to Him by the sheriff office..
The sheriffs office has put 2 calls into the buyer, but he will not return the calls…

Can church get reinburst for what was sold,
All of the receipts was also destroyed or sold and some of the purchases was in cash…

Please help!!

I have NEVER heard of the sheriff being involved in a sale or closing of property. The sheriff NEVER has rights to the property, and never has ownership to turn over.

Seven years ago, a family member bought a condo with a VA home loan. The mortgage company sold the account to Fleet who stopped sending bills or coupons for payments. Essentially, they screwed my family member and after two late payments (it took 18 days to process because there was no payment coupon included) they started foreclosure procedures. Really bad company to do business with. She had no choice but to file bankruptcy. They forclosed on her in less then two months and the condo sat vacant for over a year and a half. No one helped her and the mortgage company even hung up on me when I called them. Can she qualify for a VA home loan again?

I am so sorry to hear this kind of thing happening to our veterans that served our country. It is horrible and I am very sad for you. I reviewed the guidelines and according to the VA regulations regarding entitlements for home loans it does not appear that your family member would be able to get another VA home loan. It would be a good idea to contact the Veterans Administration directly and inquire about obtaining another "certificate of eligibility", especially if there is no outstanding deficit judgment. FYI: if veterans have financial problems they can call the VA for help prior to the act of foreclosure or bankruptcy. See the below website and let any other veterans they can call for help, they are not alone!
