How do I stop a foreclosure?

We got about a month behind on our mortgage right after hurricane Ivan due to damages and my husband out of work (his work was damaged). We have our mortgage through Ameriquest. We almost had it caught up and they upped the interest rate twice, increasing the monthly payment, that plus the late fees keep piling up. We wound up two months behind. I sent this months’ payment in plus an extra $100, but they still haven’t applied it to my mortgage. What do I do? And if they are starting the preforeclosure things will they refuse my monthly payment? BTW, I live in Florida. I don’t want to lose our house. If we can just work out the two back payments and slack off on the late fees, we can make the mortgage payment ok.

Contact the housing department. It is not legal for them to just up and raise your interest rate unless you asked them to.

Additionally I would send them a copy of your husbands unemployment claim.

Another idea is to check your homeowners insurance, you should have coverage as your home was damaged in a natural disaster.

Can I sue my landlord for breaking our lease since the house is in foreclosure?

We live in California and just moved into this house in February. We signed a lease for a year through a Property Managing Company. Our lease states the landlord is suppose to make all mortgage payments. After we moved in the landlord stop making his loan payments and now the house is being foreclosed. What rights do we have? How long do we have until a sherriff locks us out? Can we sue our landlord or the Property Managing Company for breaking our lease? Please help!!!!!

You will want to research this further, but in terms of somewhere for you to start; the contract you signed "lease" is actually considered "Real Property" and goes with the Real Estate and whomever has possession of that piece of Real Property (it gets sold with the home, if it’s not terminated by another document). I don’t know for sure, but I would guess that you would stay tenants to the new owner (wich will be the bank if the property gets foreclosed). I’m sure there are several loopholes (that are not in your favor) to evade something like that, but I’m not experienced enough with that issue to be able to advise you further.

does bankruptcy stop foreclosure?

Will filing bankruptcy (7 or 13) stop foreclosure? Do they take the house?

Either way, filing bankruptcy and including your mortgage loan in the petition will temporarily stop any foreclosure proceedings. The automatic stay will be in effect, which will prohibit any creditors from pursing collection activities for as long as the stay is in place. This means that the bank can not move ahead with its lawsuit against you, nor have the house sold at a county sheriff sale.

But where the house goes from there depends on whether you file Chapter 7 or Chapter 13 bankruptcy. There are big differences between the two, and state exemptions and rules may determine which one you best qualify for and what property you get to keep. The best idea is probably to consult with a personal bankruptcy lawyer before moving ahead with either filing, although it is quite possible to file bankruptcy on your own.

A Chapter 7 will allow you to discharge your unsecured debts and secured debts, as long as the creditors have access to the collateral for which the loan was guaranteed. That means that you can discharge your mortgage under this type of filing, but the bank will get to keep the house. You will also not have to worry about a deficiency judgment, as the house will be considered the best the bank can expect and any remaining balance on the mortgage will be discharged.

With a Chapter 13, you will enter into a payment plan in order to get caught up on the debts that you have fallen behind. Currently, bankruptcy judges do not have the authority to lower mortgage balances, so you would have to pay back the total amount you are behind as well as keep up on your regular monthly mortgage payment. For many homeowners, this can be expensive; although, if you make it through the 3-5 year plan, you will get to keep your home. If you fall behind, the bank will most likely have the automatic stay lifted and put the house back into foreclosure.

How many times can you let a house go into foreclosure?

I own three houses. How many times can i let house go into foreclosue? Would the bank just stop letting me come up with payments late,and call in the loan?

You can let your house go into foreclosure as many times as you run out of money to pay the mortgage for a period of months. The bank will wait until you are usually 3-6 months behind, and then start to file the foreclosure paperwork in court. If you pay them back before the property is auctioned off, then the foreclosure process has to stop.

It is unlikely that the bank would just stop taking any payments from you at all and call in the loan. After all, your original mortgage contract states that you have to pay a set amount of every month or incur penalties and other charges if the house is foreclosed on. There’s nothing in the loan documents that would allow them not to take your payments any longer.

It would also be difficult for them to prove to a court that they are entitled to anything besides your monthly payments if you can make them and pay back any amount you are behind. just because you fell behind in the past does not mean that the bank can just give up on the loan completely — as long as you made up the payments later on, they got everything they were due, plus a lot of interest charges and late fees.

In fact, if your houses are going into foreclosure or falling behind quite often, but you are able to pay back the arrears eventually, then you may be a good client from the bank’s perspective. With all of the extra fees they are charging you when you miss a payment, your effective interest rate may be much higher than you think, which translates into higher profits on your loan for the lender.

Of course, that might also be a good reason to try and keep up on the payments at all times, or just let one house go if it is not affordable. Selling or giving the bank a deed in lieu of foreclosure on one property might let you off the hook on it, while allowing you to keep the other properties and make the payments a lot more consistently.

my sister has missed her house payment for a few months now because my brother in-law lost his job but she wants to save her house what should she do? or is there a company that can help? she needs to come up on $5,0000 with in 30 days

5k is not very much, a garage sale, maybe sell the boat and she will be all set.

She needs to call the bank, but I doubt she is in foreclosure yet.
