hello, i received summons for foreclosure 10/27,09, I answered them and demanded a trial. i as of yet have not been notified of a date set yet. i do not have an attorney, i just spoke with lender, to get payoff amt, just curious, he told he a sale date was set for this month, i contacted sheriff , no NO date has been set, i’m not even done with court. lender lied to me, scare tatics to sign again. i am standing on them having lack of standing, lack of consideration, counterfeit securities, conversion and no jurisdiction. they set me a set of interrogatories, i gave them the same answer to all over 50 questions, when they were only suppose to ask me around 40 questions. i answered each one as my being the creditor. they have at this time not filed anything else or mailed me anything else. What is my next move ? should i file a Notice to Dismiss? should I Subpoena them for all entries and records to show if at any time their money was at risk? AS i know it never was and never will be due to federal policy they can NOT lend money so no money was ever at risk. They were paid in full when that original note was signed of which they stamped the back , thus altering it , to deposit it and never be seen again . Thus being sold on the secondary market to investors and bond holders. They are NOT the real pary in interest. What’s my next move ?
